Topeka, KS Building Safety: Fire Sprinkler Requirements (2026)

TMC § 14.40.010 adopts the 2021 International Fire Code, as amended, by reference as Topeka's fire code, with a copy on file at the City Clerk's office (§ 14.40.020). Section 14.40.120 rewrites IFC Chapter 9, Section 903.2.8 (Group R) for the City: an automatic sprinkler system installed to Section 903.3 standards must be provided throughout all buildings with a Group R fire area, meaning apartment houses, hotels, and most other residential occupancies. The amendment carves out two exceptions: first, a building of no more than two single-family dwelling units combined with nonresidential occupancies doesn't need sprinklers, provided a fire alarm and detection system is installed and monitored under NFPA 72 in both the residential units and the nonresidential areas; second, any building consisting solely of four units or fewer is exempt from sprinklers entirely, with no alarm substitute required.

Where a permit is required under this fire code, the fee is set by the City's Fee Schedule rather than a flat amount in the ordinance (§ 14.40.055). Appeals from a fire code determination go to the Board of Building and Fire Appeals created under TMC § 2.235.010 (§ 14.40.060), not the municipal court in the first instance. Contractors performing inspection, testing or maintenance on fire and life-safety systems, including sprinkler systems, must electronically submit compliant and noncompliant reports to the Topeka Fire Department within 30 days of the work, and those records must be kept on the premises for at least three years (§ 14.40.070).
