Schenectady, NY Building Safety: Green Building Code (2026)

Schenectady does not run an independent green-building ordinance. Chapter 137, Building Code Administration, adopted by Local Law 6-2006 under Municipal Home Rule Law § 10, instead sets up the local machinery that enforces two state instruments: the New York State Uniform Fire Prevention and Building Code (the "Uniform Code") and the State Energy Conservation Construction Code (the "Energy Code"). Section 137-1 states that this chapter provides for the administration and enforcement of both codes in the City, and that except as otherwise provided, all buildings, structures, and premises are subject to it regardless of use or occupancy.

Energy Code compliance is not a side issue folded into general construction rules; it runs through the same permit and inspection machinery as any other building work. A building permit is required under § 137-4A for any work that must conform to the Uniform Code and/or the Energy Code, and § 137-5B(9) lists Energy Code compliance as one of the specific elements the Code Enforcement Officer must inspect during construction, alongside footings, framing, and fire-resistant construction. The Code Enforcement Officer, appointed by the Mayor and designated the Building Inspector under the City Charter, administers and enforces the Energy Code with the same authority used for the Uniform Code, including issuing compliance orders and stop-work orders.

Enforcement carries teeth: § 137-16C makes any person who violates the Uniform Code, the Energy Code, or the chapter itself liable for a civil penalty of not more than $200 for each day the violation continues, recoverable in a City-initiated civil action, in addition to whatever penalties state law separately prescribes.
