Cumberland County Zoning Ordinance Section 1102 I (Building Height) provides that 'Multiple family dwellings and office, commercial and industrial buildings shall not be limited to height except that for each one foot of height greater than 35 feet, the side and rear yard setbacks shall be increased by one foot.' So taller buildings must step back farther from side and rear lines rather than meet a fixed cap. Building height is defined as the vertical distance from the average finished grade at the front of the building to its highest point, excluding spires, cupolas, chimneys, and antennae. These provisions govern unincorporated county land; Fayetteville and the towns set their own height limits.
Adding height without the matching increased setback is a zoning violation; a $500 civil penalty accrues $500 per day until corrected (Section 1704).
