Perth Amboy, NJ Building Setbacks & Zoning: Structure Height Limits (2026)

Perth Amboy City Code § 430-58(E) sets the height caps for two residential conditional uses. Subsection (3) governs high-rise multifamily residential development: maximum permitted height is one hundred feet, and maximum permitted height in stories is ten. Subsection (11) governs two-family dwellings in zones that permit them as a conditional use: maximum permitted height is twenty-eight feet and the maximum number of stories is two. The height column of the district schedule for ordinary residential lots sits in the Bulk Schedule attachment that § 430-9 refers to, and that table is not reproduced in the code text.

Accessory structures have their own cap. Section 430-60(A)(4) says no accessory building within any zone shall exceed fifteen feet in height.

Section 430-60(H) lists what the height limits of Chapter 430 do not reach: church spires, fire walls, belfries, cupolas, chimneys, ventilators, skylights, bulkheads and similar features and necessary mechanical appurtenances carried above the roof level. Those features can rise only as high as needed to do their job. The same subsection allows parapet walls or cornices for ornament, without windows, to stand above the building height limit by not more than three feet. Quasi-public buildings, public buildings, schools and churches can exceed the district height limit, but they must add one foot to the front, rear and side yards for each foot of excess height.

Because a height cap in a conditional-use standard is a condition of the approval, the approving board reviews it as part of the conditional use application under § 430-58(B), with site plan review, a public hearing, and the burden of proof on the applicant. A zoning permit signed by the Zoning Officer is required before a structure is erected or altered, per the definition in § 430-5.
