Perth Amboy, NJ Parking Rules: Driveway Rules (2026)

Parking placement is set in § 430-61A(11) of the Perth Amboy City Code: parking areas can be located in any rear or side yard but cannot be located in any required front yard area, except a parking space in front of an operable garage and except where the Article specifically permits it elsewhere. The rule was added on 9-21-2005 by Ord. No. 1304-2005.

The yard rules in § 430-60R(2) complement it. No front yard and no side yard can be used for open storage of boats, vehicles or any other equipment, except for parking on driveways in a residential zone for the parking of passenger vehicles. A driveway is the one front or side yard surface where passenger vehicles can be parked in a residential zone.

The construction standard for that driveway is § 430-61C(10). Access drives for single- and two-family dwellings use concrete aprons without curb returns, regardless of size or location. Such drives have a minimum width of ten (10) feet and a maximum width of twenty-four (24) feet when they provide access to a garage and/or driveway. All such residential driveways are paved with a minimum of four (4) inches dense aggregate grade subbase and two (2) inches FABC, Mix 1-5, so a gravel or bare-dirt driveway does not meet the code.

Location and apron details follow. No part of a driveway can be within five (5) feet of a side property line, including the extension to the curbline, for single- and/or two-family dwellings, and twenty (20) feet for all other uses. The maximum curb depression for single- and two-family dwellings is the driveway width plus four (4) feet, but not more than twenty-five (25) feet. Driveway aprons are required between the curbing and the sidewalk and are six (6) inches of concrete. Section 430-61A(6) adds that no access drive or driveway in any residential district can be used to provide access to uses other than those permitted in that residential district.
