030, it is unlawful to establish, operate, engage in, conduct or carry on any sexually oriented business in Chula Vista without first obtaining a sexually oriented business regulatory license; any expansion of floor area by more than 10 percent counts as a new establishment requiring a fresh application. Applicants file at the Development Services counter with proof they are at least 18, criminal-history disclosures for the applicant and every performer or nonperformer, a floor-plan sketch accurate to within six inches, and a parking and lighting diagram.

The Director must find an application complete within five City business days, investigate and hold a public hearing (noticed under Gov. 024 zoning rules. Those zoning rules restrict the use to the C-T zone or listed specific-plan areas and impose a 500-foot buffer from residential zoning, schools, parks or religious institutions plus a 1,000-foot buffer between sexually oriented businesses. (except adult hotels/motels), require an on-site manager at least 18 who cannot be a performer and reports to the Chief of Police, prohibit propped-open exterior doors, and require opaque window coverings.

A license can be suspended up to six months or revoked by the Director after a noticed hearing for zoning or operational-standard violations, false statements, inactivity of six months or more, or an employee's conviction of two or more specified criminal offenses on the premises within 12 months; a revoked business cannot reapply for that location for 12 months.
