Summary

Article 36 of the Comprehensive Zoning Ordinance keeps every 'regulated use,' adult bookstores, cabarets, motion picture theaters, peep shows and figure studios among them, at least 1,000 feet from any other regulated use and 1,000 feet from a residential district, school, park, church or child care site. Businesses with First Amendment protection get an Administrative Regulated Use Permit instead of a discretionary use permit.

Regulated Uses that have First Amendment protections shall require an Administrative Regulated Use Permit (ARUP) as called out in Section 3606. The balance of the Regulated Uses listed in this Section, shall require a use permit issued in accord with Article 41, however, the City Council shall have final authority to approve or disapprove the use permit.

3604 Locational Requirements

A. It shall be unlawful for any Regulated Use to be located closer than one thousand (1,000) feet to any other Regulated Use, except as noted herein. This distance shall be measured in a straight line, without regard to intervening structures from the closest point on the exterior structure walls of each business.

B. It shall be unlawful for any Regulated Use listed as Items A, B, C, D, E, F, M, P or R of Section 3602 to be located closer than one thousand (1,000) feet from any residential district or any parcel of land which contains any one or more of the following specific land uses: 1. Public or Private School; 2. Park, playground or public beach; 3. Church or other similar religious facility, and 4. Child care or pre-school facility.

Full Breakdown

Section 3602 lists 21 'Regulated Uses' subject to Article 36's separation rules, including adult bookstores and video stores, adult cabarets, adult entertainment businesses, adult motels, adult motion picture theaters, adult theaters and peep-show establishments, alongside arcades, bars, bathhouses, body-piercing shops, escort services, figure studios, massage establishments, cannabis facilities, payday lenders, pool halls, tattoo parlors and tobacco or drug paraphernalia shops. A regulated use protected by the First Amendment, the adult-business categories, needs only an Administrative Regulated Use Permit under Section 3606; every other regulated use needs a discretionary use permit under Article 41, with the City Council holding final say.

Section 3604's locational requirements do the real work. No regulated use can open within 1,000 feet of another regulated use, measured in a straight line between the closest exterior walls. Adult bookstores, cabarets, entertainment businesses, motels, motion picture theaters, adult theaters, figure studios, cannabis facilities and peep shows also cannot sit within 1,000 feet of a residential district, a public or private school, a park, playground or public beach, a church, or a child care or preschool site. Every other regulated use on the Section 3602 list, bars, massage parlors, pool halls and the rest, gets a shorter 500-foot buffer from those same residential districts and sensitive sites.

Tattoo establishments carry their own 500-foot rule under Section 3604(C), with an exception where Interstate 5, SR-76 or SR-78 physically separates the shop from housing. Operators who cannot meet the distance table can apply for a waiver of the locational requirement under Section 3605, except that no waiver is available for the adult-business permit track or for the cannabis school-distance rule in Section 3604(D).

Violations & Fines

Opening a regulated use without the required Administrative Regulated Use Permit or discretionary use permit, or inside the 500- or 1,000-foot buffer, is a zoning violation subject to Sections 4705 and 4706: an infraction fined under Government Code Section 36900 for the first three occurrences in a year, escalating to a misdemeanor with that fine, up to six months in jail, or both, on the fourth, with the City Attorney authorized to sue for abatement and removal.

Frequently Asked Questions

How far must an adult business stay from a school in Oceanside?
Section 3604(B) sets a 1,000-foot buffer between an adult bookstore, cabaret, entertainment business, motel, motion picture theater, adult theater, figure studio or peep-show establishment and any public or private school, park, playground, public beach, church or child care facility, measured in a straight line from the closest exterior walls or parcel lines.
What permit does an adult bookstore need?
Because adult bookstores, cabarets and similar uses carry First Amendment protection, Section 3602 routes them to an Administrative Regulated Use Permit under Section 3606 instead of a discretionary use permit. Every other regulated use on the Article 36 list, from massage establishments to pool halls, needs a use permit issued under Article 41, with final authority resting with the City Council.
Can two adult businesses operate next door to each other?
No. Section 3604(A) makes it unlawful for any regulated use to locate within 1,000 feet of any other regulated use on the Section 3602 list, measured in a straight line between the closest points of each building's exterior walls, without regard to what stands in between.
