Article 36, Section 3602 lists 'Tattooing Establishments' as Item T among the city's Regulated Uses, a category that also covers adult businesses, massage parlors and cannabis facilities because of shared secondary-effects concerns. Section 3604(C) sets the tattoo-specific buffer: a tattoo studio cannot sit closer than 500 feet to any other tattooing establishment, to any residential district, or to a Sensitive Land Use, which the ordinance defines as a public or private school, a park, playground or public beach, or a child care or pre-school facility.

The only carve-out is an intervening freeway: if Interstate 5, State Route 76 or State Route 78 physically separates the site from the residential district, the 500-foot residential buffer does not apply. Distances run in a straight line from the exterior wall of the tattoo business to the district line or the nearest structure wall of the sensitive use, without regard to what stands between them. Because tattooing is treated as constitutionally protected expression under Section 3606, an applicant needs an Administrative Regulated Use Permit (ARUP) issued by the City Planner rather than a Conditional Use Permit from the Planning Commission or City Council.

The Planner has 10 business days to declare an application complete and 60 days after that to approve or deny it, checking the Article 11-13 zoning, the Section 3604 spacing rules, and any operational conditions in the Oceanside City Code. Section 3605's locational waiver process is closed to tattoo studios: it expressly excludes any Regulated Use that is 'subject to Section 3606,' so the 500-foot lines in Section 3604(C) are fixed once the freeway exception does not apply.
