Full Breakdown

650 as any place of business that tattoos people by placing designs, letters, scrolls, figures, symbols, or other marks under the skin with ink, using needles or instruments. 140(A)) apply on top of the three special regulations written specifically for this use. First, no tattoo parlor may be located within 500 feet of any establishment licensed to dispense alcoholic beverages for on-site or off-site consumption, a distance measured to reach bars, restaurants with liquor licenses, and off-sale liquor stores alike. Second, a tattoo parlor cannot operate in conjunction with, or share any operating space with, another business, so a shop cannot double as, say, a barbershop or piercing studio in the same leased space under one storefront.

Third, like several other conditionally-permitted uses in this same subsection (adult businesses, drug paraphernalia stores, escort services), the parlor must provide an opening giving an unobstructed view of the interior from outside the building, a visibility requirement aimed at allowing passersby and code enforcement to see into the space. 120 if the operator violates these conditions.

Violations & Fines

Operating a tattoo parlor without the required conditional use permit, inside the 500-foot alcohol-seller buffer, or sharing space with another business is a zoning code violation the City Planner can pursue as a code enforcement matter, and the Planning Commission or City Council can revoke or modify the conditional use permit under Section 21.42.120 for noncompliance with any condition of approval.

Frequently Asked Questions

Can a tattoo parlor open next to a bar in Carlsbad?
No. Carlsbad Municipal Code Section 21.42.140(B)(140) bars any tattoo parlor from locating within 500 feet of a business licensed to dispense alcoholic beverages, whether for on-site consumption like a bar or restaurant or off-site consumption like a liquor store.
Does a tattoo shop need a special permit in Carlsbad?
Yes. Tattoo parlors are listed among the minor conditional uses and conditional uses in Chapter 21.42, so an operator needs a conditional use permit reviewed under the zone's development standards before opening, not just a standard business license.
Can a Carlsbad tattoo parlor share a storefront with another business?
No. Section 21.42.140(B)(140)(b) specifically prohibits a tattoo parlor from being operated in conjunction with, or sharing any operating space with, any other business, unlike some other conditional uses in the code.
