Oceanside, CA Business Licensing & Operations: Tobacco Retail License (2026)

Sec. 1 makes it "unlawful for any tobacco retailer to engage in the sale of any tobacco product" without three things at once: an annual tobacco retail license for each location where tobacco is advertised or sold, a city business license issued under Sec. 2, and any state or County of San Diego permits the business needs. Sec. 2 lays out the application and discipline process. Applications go in on a city form, must be signed by each proprietor, and must disclose the retailer's contact information, the property owner and lease, and any license or permit suspension or revocation history from the past five years.

The city must issue the license once the application and fee are complete, unless the applicant has a false statement in the application, is seeking to operate at an address whose license was recently suspended or revoked, would be operating unlawfully under city zoning, or was convicted, fined, or disciplined within the prior five years for a tobacco-control or minor-alcohol-sales violation. The license runs one year from issuance, is not transferable between people, businesses, or locations, and renews on payment of another administration fee set by city council resolution.

Suspension and revocation escalate with each violation: a first violation within five years draws a 30-day suspension, a second draws 90 days, and a third results in outright revocation. A license can also be revoked immediately if a denial ground existed when it was issued. Appeals of a denial, suspension, or revocation run through Sec. 5(3) of the code.
