Escondido, CA Business Licensing & Operations: Tobacco Retail License (2026)

Municipal Code Sec. 16-197 makes it unlawful to act as a tobacco retailer in the city without a valid tobacco retailer license issued under Division 6, adopted by Ordinance No. 2020-29R. Sec. 16-199 requires a separate application for each physical location, disclosing every owner's identity and any prior license suspension or revocation, and Sec. 16-199(d) gives the police chief up to 30 days to complete a background investigation. Sec. 16-200 conditions issuance on paying the license fee and passing a background check showing no administrative, civil, or criminal violations of tobacco sales law, and Sec.

16-200(b) bars issuance outright if the applicant had any sales-to-a-minor violation within the prior 12 months. Renewal, under Sec. 1, is aligned with the holder's regular business license renewal date effective July 1, 2021, and an untimely renewal is automatically suspended by operation of law until the fee is paid. The license is nontransferable under Sec. 2, and Sec. 4 imposes operating rules: retailing only from a fixed location, prominent display of the license, checking ID for anyone who appears under 21, a ban on self-service displays including vending machines, and a ban on tobacco advertising displays placed below four feet from the floor.

Sec. 5 sets a graduated penalty ladder: a first violation may draw a warning, a second violation within 60 months a 90-day suspension, a third a one-year suspension, and a fourth a mandatory revocation, though the chief of police can skip the warning for multiple violations within 30 days or for any unauthorized sale.
