Section 16E-3(a) makes it unlawful to establish, operate, engage in, conduct, or carry on any adult business in Escondido without first obtaining, and continuing to maintain, an adult business regulatory license, and any expansion, relocation, or conversion into an adult business requires a new license application under the definition of 'establishment' in Section 16E-2. The Planning Commission grants, denies, and renews these licenses under Section 16E-3(b). Applicants must file a verified application disclosing legal names and aliases, proof of age 18 or older, corporate or partnership details, and a signed statement confirming they have not pleaded guilty or been convicted of a sex-related offense within two years for a misdemeanor or five years for a felony, under Section 16E-3(c).

The application requires a nonrefundable fee set by council resolution, a floor plan accurate to within six inches, and a parking and lighting diagram, under Section 16E-3(c)(9)-(10) and (d). The director of community development must find the application complete within five business days, under Section 16E-3(e). Once complete, the Planning Commission must hold a noticed public hearing within 21 days and issue a written decision within two business days of the hearing; failing to decide within those windows is deemed an approval, subject to appeal, under Section 16E-4.

Every adult business must staff an on-site manager at least 18, or 21 if alcohol is served, who is never also a performer, to receive complaints. 4, and a revoked licensee cannot obtain a new adult business license for 12 months, under Section 16E-7.
