Chapter 16A, Article 4 governs massage establishments separately from the massage-technician certification rules in Article 2. Section 16A-25 requires an annual permit from the chief of police before anyone may own or operate a massage establishment, and operating at a new address or under new ownership before that new permit issues is itself unlawful. The permit expires one year from issuance, timed to the city business license cycle under § 16A-26. To apply, an owner must submit a sworn application under § 16A-27 that includes the owner's name, address, date of birth and government-issued ID; corporate formation documents for any LLC or corporation; a signed statement authorizing a background check; fingerprinting; proof of liability insurance; a state tax ID; and a current CAMTC certificate for every technician who will work on site.

The chief of police has up to 30 days after receiving a complete application to finish the investigation. Section 16A-28 sets the approval standard: the establishment must comply with building, zoning, business-license and health regulations, employ only CAMTC-certified technicians, and the owner must not have a Penal Code § 290 registration, a prior injunction for nuisance, or a license revoked by another agency within the last five years. A permit may be suspended or revoked under § 16A-29 for a chapter violation, a material misrepresentation on the application, or fraud, with repeat violations or criminal charges creating a prima facie basis for revocation; an owner can appeal that decision under § 16A-30.

Zoning separately confines massage establishments to specific commercial shopping centers or to the General Commercial (CG) zone with a conditional use permit, and operating without the required massage establishment permit or in violation of the locational rules exposes the operator to permit revocation and a fine of up to $1,000 under Government Code §§ 36900-36901.
