Eden Prairie, MN Business Licensing & Operations: Adult Entertainment (2026)

Section 5.77, adopted by Ordinance No. 27-2018, makes it unlawful under Subdivision 3 for any person to own or operate a sexually oriented business in the City of Eden Prairie without first obtaining a license. The definition sweeps in adult bookstores, adult cabarets, adult motion picture theaters and arcades, adult modeling studios, adult massage parlors, and businesses devoting more than twenty-five percent of inventory, floor area, or gross revenue to sexually oriented materials. Subdivision 5.B bars a license for any location not permitted under City Code Chapter 11 zoning, for a premises already licensed as a pawnshop or therapeutic massage enterprise, for any premises holding a liquor license, and for premises with delinquent City taxes or assessments.

Subdivision 5.A separately disqualifies applicants who are not U.S. citizens or resident aliens, are under eighteen, have a pending charge for prostitution, sex trafficking, or criminal sexual conduct, or had a similar license revoked anywhere within the past five years; the manager, partner, or corporate officer must also reside within the seven-county metro area defined by Minnesota Statutes Section 473.121, Subdivision 2. Licensed premises cannot exceed ten thousand square feet under Subdivision 7.G.2, must exclude anyone under eighteen under Subdivision 7.D, and cannot let sexually oriented materials or entertainment be visible or audible from outside the building under Subdivision 7.F.1.

A live performer must stay at least ten feet from the audience on a platform raised at least two feet, per Subdivision 7.F.3. Subdivision 7.H caps hours: businesses cannot open between 1:00 a.m. and 8:00 a.m. Monday through Saturday, or between 1:00 a.m. and noon on Sundays. The Chief of Police administers suspension and revocation hearings under Subdivision 8, and violation of the section is a misdemeanor under Subdivision 11.
