20, adopted by Resolution of May 11, 2022, makes it unlawful to operate an adult establishment, defined to include adult arcades, bookstores, cabarets, motion picture theaters, and sexual device shops, without a license, and unlawful for any employee to work there without an adult establishment employee license under Sec. 030. 00 annual renewal under Sec. 050. Sec. 190 bars an adult establishment from operating within 750 feet of any residence or residential zoning district, within 750 feet of an educational institution, religious institution, government building, library, civic center, park, hospital or prison, within 750 feet of any establishment licensed to sell alcohol, or within 500 feet of another adult establishment, measured in a straight line from the closest structure to the closest property line.
A lawful nonconforming adult establishment predating the 2022 ordinance had until December 31, 2023 to conform, with a hardship extension process requiring an application filed by October 31, 2023 and a public hearing before an independent hearing officer. Sec. m. Interior operating rules in Sec. 0 foot-candles of interior lighting, an unobstructed operator's station sightline into every viewing room, and viewing rooms under 100 square feet limited to one patron at a time. Sec. 170 bans full nudity outright, requiring semi-nude performers to stay at least six feet from patrons on a stage at least 18 inches off the floor in a room of at least 600 square feet, bans alcohol on the premises entirely, and bars anyone under 18 from the premises.
Violations & Fines
A violation of Chapter 5.20 is punishable by a fine up to $1,000.00 per violation, imprisonment up to 60 days, or both, with each day of a continuing violation counted as a separate offense under Sec. 5.20.150(A). The director can suspend a license for up to 30 days for a knowing or reckless violation under Sec. 5.20.080, and must move to revoke for a second suspension within 12 months, false application information, drug or prostitution activity on premises, operating during suspension, or three violations within 12 months under Sec. 5.20.090. Revocation bars relicensing for one year. Premises repeatedly operated in violation constitute a nuisance subject to civil abatement.
