Chapter 21.26 confines every sexually oriented business in Monterey Park to the Office Professional (O-P) zone, and § 21.26.020(A) makes even that zone conditional: the business must first win a special use permit from the City Council on a Planning Commission recommendation, and separately obtain a sexually oriented business license before opening. The City Council has 90 days from a complete application to act under § 21.26.040; miss that deadline and the application is deemed approved if the business otherwise satisfies the chapter's standards. Distance rules under § 21.26.020(B) and (C) keep these uses away from other activity: 500 feet from any freeway, 300 feet from any major arterial street, and 500 feet from any residential zone or parcel, religious institution, or school, public or private, or public park, each measured in a straight line between the nearest points involved, without regard to intervening structures.

Operational standards in § 21.26.030 go well beyond zoning. The business must close between 12:00 a.m. and 8:00 a.m., cannot admit patrons or employees under 18, and must post a minors-prohibited notice at every entrance. Live entertainment requires a stage at least 18 inches high, a 10-foot buffer between performers and patrons, and separate entertainer dressing rooms and entrances. Security guard staffing scales with occupancy: at least one guard whenever the business features live entertainment, an additional guard once occupancy passes 35, and more if the Police Chief determines they are necessary above 70.

Parking lots need at least one foot-candle of lighting from dusk to closing, alcohol sale or consumption is barred outright, and landscaping cannot exceed 30 inches except trees. Section 21.26.050 lets the City Council suspend or revoke the special use permit for any material violation of these rules, an unapproved use expansion, or six months of nonuse.
