Full Breakdown
Section 7-13-1-1317 adds massage-specific rules on top of the general Article 7-13 adult business licensing framework. It requires every massage establishment be kept at all times in a clean and sanitary condition and bars operating in connection with, either directly or indirectly, any place used for living or sleeping quarters. During treatment, no patron shall receive a massage unless the patron is covered by opaque material such as a towel or shorts covering the hips, genitals, anal areas, and if the patron is female, the breasts as well.
Subsection D makes it unlawful for any employee to touch a patron's genitals, anal area, or a female patron's breasts, and separately unlawful for alcohol or non-intoxicating beverages to be sold, distributed, stored, dispensed or consumed on the premises. The rule also bars anyone under 18 from receiving services unless accompanied by a parent or guardian or acting on a physician's prescription, and prohibits any controlled substance on the premises or encouraging acts of masturbation on-site. Because massage parlors fall under the Article 7-13 definition of massage parlor, the operation also needs the Section 7-13-1-1307 adult business license unless the practitioner is a licensed hospital employee, physician, chiropractor, osteopath, licensed physical therapist, member of a national massage therapist association carrying liability insurance, or licensed barber or cosmetologist working within that trade.
Violations & Fines
Operating a massage establishment from living or sleeping quarters, allowing an uncovered patron on the table, or permitting an employee to touch a patron's genitals, anal area or breasts each violates Section 7-13-1-1317(A) through (D). Selling or allowing alcohol on the premises, admitting an unaccompanied minor without a guardian or prescription, or allowing controlled substances on site are separately prohibited and can support license suspension or revocation under Section 7-13-1-1320.
