Full Breakdown

15(f)(1)(A)(ii). 020 then layers city-specific amendments on top of the adopted county text, most notably a revocation scheme at Sec. 12: a first permit revocation blocks a new permit at that location for at least 10 days, a second within 60 months blocks it for 90 days, a third blocks it for a year, and a fourth or more blocks a new permit for five years. The Director of the Department of Health and Human Services runs the permitting and revocation process, decisions are appealable to the Tobacco Retailing Permit Hearing Authority, and the city attorney can negotiate settlements with retailers for a first or second alleged violation without needing city council approval.

Violations & Fines

Selling tobacco without a valid permit under the adopted Sec. 6-15.14 bars a retailer from being issued a license at that location for 30 days after a first violation, 90 days after a second, and five years after a third or subsequent violation within any 60-month period. The District Attorney can pursue civil penalties of $250 to $1,000 for a first violation, $1,000 to $2,500 for a second, and $2,500 to $5,000 for a third or later violation under Sec. 6-15.15(c), and product found in violation is subject to seizure and forfeiture.
