DuPage County, IL Business Licensing & Operations: Tobacco Retail License (2026)

Section 20-141 makes it unlawful to sell, give away or keep tobacco products for sale in the County without a tobacco seller's license, and the definition of 'tobacco products' in § 20-140 expressly includes electronic cigarettes and alternative nicotine products as defined by the state's Prevention of Tobacco Use by Minors Act. Section 20-142 requires a written, notarized application to the County Clerk with a nonrefundable $100 filing fee, and renewal applications are due at least 30 days before the license period ends each August 31 or the license lapses.

Section 20-143 sets the annual license and renewal fee at $100 per point of sale, meaning a business with multiple registers or vending machines under one roof needs only one license, but separate locations each need their own. The DuPage County Sheriff's Office must inspect every retail tobacco vendor for compliance at least three times a year under § 20-144, and may use supervised minors in compliance checks. Section 20-145 bars sales to anyone under 21, and § 20-149 bans selling tobacco within 100 feet of any school, child care facility or other building used for education or recreation for people under 21, though retailers already selling there before the article's enactment can still get licensed. Sections 20-150 through 20-152 also ban free tobacco giveaways, single cigarette sales, and unlocked vending machines that minors could operate.
