Vallejo, CA Business Licensing & Operations: Tobacco Retail License (2026)

Section 5.10.020 makes tobacco retailing without a valid city license a nuisance as a matter of law and bars self-service displays, delivery sales, and sales to anyone under 21 without government-issued photo ID. Section 5.10.050 sets the eligibility limits: no license for a moveable vending operation like a cart or truck, none for a location licensed for commercial cannabis activity, and none inside a pharmacy. New licenses cannot issue within 1,000 feet of a youth-oriented facility, a school, library, playground, youth center, park, or licensed child-care facility, measured property line to property line, nor within 1,000 feet of another already-licensed tobacco retailer or a licensed cannabis retailer. On top of the spacing rules, Section 5.10.050(G) caps the citywide total at one tobacco retailer license for every 2,500 residents, based on the most current U.S. Census Bureau or California Department of Finance population figure.

Retailers operating lawfully before the ordinance's December 10, 2024 introduction keep their eligibility if they filed a complete application within 90 days, have not closed for more than 90 consecutive days, and have not substantially changed the business, including moving to a noncompliant location or racking up three or more chapter violations in five years. Anyone who misses the 180-day compliance window after the ordinance's effective date must meet the full density and proximity requirements from scratch. Section 5.10.060 requires the application to name every proprietor, prove any required Title 16 zoning entitlement, and disclose violation history for the past five years; the license itself, per Section 5.10.080, runs one year and requires renewal at least 90 days before expiration.
