Summary

Daviess County runs non-consent, accident-scene towing through Sheriff-administered wrecker, body-shop, and storage service lists under Code § 30.02. A wrecker company pays a $250 annual regulatory fee, must run 24-hour service, and gets dispatched on a rotation only when the vehicle owner or operator states no preference for who tows the car.

These county ordinances apply to unincorporated areas of Daviess County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(D)(1) Wrecker service list. All wrecker service businesses in the county shall be eligible for inclusion on the wrecker service list provided said business meets all of the following requirements and conditions. (a) All wrecker service businesses must submit a written application in a form and format approved by the County Sheriff and pay an annual regulatory service fee of $250. (b) The wrecker service must provide 24-hour service, seven days per week... (H)(3) ... (a) For the first violation, wrecker service, auto body repair, or storage facility may be suspended from its respective service list for a period of time not to exceed six months. (b) For a subsequent violation by the same offender within a two-year period, suspension from the appropriate list for at least six months, but not to exceed one year. Any subsequent violation by the same offender within a two-year period shall result in permanent removal from the appropriate list.

Full Breakdown

02: wrecker service, auto body repair, and approved vehicle storage. Each wrecker business submits a written application to the Sheriff and pays a $250 annual regulatory service fee, must be independently owned and operated from one location, run 24-hour emergency service seven days a week with a local emergency phone number, carry a minimum one-ton weight rating with a motor-driven winch, wheel lifts, dollies, an ABC fire extinguisher, safety chains, axe, broom and shovel, and furnish the Sheriff proof of insurance and a current itemized rate list.

Wrecker services cannot charge the Sheriff's rotation customers more than they charge private customers, and must give 30 days' notice before raising rates. If the vehicle owner or operator states no preference at the scene, the radio dispatcher assigns the next wrecker on the rotational list, which must then use the next storage facility on the rotational storage list. Automobile body shops on the repair list also pay a $250 annual fee and must grant wreckers 24-hour access to drop off vehicles. The Sheriff investigates complaints and reports findings to the County Judge/Executive, who decides whether a violation occurred and sets the penalty.

Violations & Fines

For a first violation the County Judge/Executive can suspend a wrecker, body shop, or storage facility from its list for up to six months. A second violation by the same business within two years draws a suspension of six months to one year, and any further violation within that two-year window results in permanent removal from the county's service list. The Judge/Executive's decision on compliance and penalties is binding and final.

Frequently Asked Questions

Can a driver choose their own tow company after a crash in Daviess County?
Yes. Under § 30.02(E), the officer at the scene must ask the vehicle owner or operator's preference and honor it if one is given, recording it on the official Department tow slip. No wrecker employee may pressure the owner about where the vehicle goes.
What does it cost a wrecker company to get on the county's tow list?
Section 30.02(D)(1)(a) sets a $250 annual regulatory service fee, plus a written application approved by the County Sheriff. The company must also carry insurance and meet equipment standards, such as a one-ton minimum weight rating and a motor-driven winch.
Can a wrecker service charge more for a sheriff-dispatched tow?
No. Section 30.02(D)(1)(e) prohibits charging more for services on the Sheriff's rotation list than the same service would cost a private customer, and requires 30 days' notice to the Sheriff before any rate increase takes effect.
