Hutto Code of Ordinances § 8.06.004(a) makes it "unlawful for a person to operate a tow truck that performs nonconsent or incident management towing in the city unless the person has a certificate of registration issued by the chief of police." Applicants must submit a verified application under § 8.06.004(b) listing every tow truck, its owners, and proof of insurance: general liability and property damage coverage of $300,000.00 for trucks under 26,000 pounds gross vehicle weight and $500,000.00 for heavier trucks, plus on-hook cargo coverage of at least $50,000.00, and a state vehicle storage facility license under Texas Occupations Code chapter 2303.

To join the city's rotation list for nonconsent and incident-management calls, § 8.06.008 requires a storage yard within 10 miles of city hall enclosed by an eight-foot privacy fence with a lockable gate, a response time of 30 minutes citywide (45 minutes for trucks 2.5 tons or larger), 24-hour phone and release service, and $1,000,000.00 in general liability coverage. Section 8.06.019 separately bans street-side solicitation of crash tows, and the presence of an uncalled tow truck at a crash scene is prima facie evidence of a violation.

Section 8.06.020 lets the chief of police pursue administrative suspension or revocation, in addition to criminal or civil remedies, for conduct endangering public safety, repeated article violations, or a zoning or fire-code violation left uncorrected one week after notice. Section 8.06.002 also makes noncompliance with state towing law itself a violation of the city article.
