Full Breakdown

5 of the Zoning Chapter, added by Ordinance No. 2112-2021 on August 19, 2021, sets the site standards every licensed Cannabis Establishment in Edison Township must meet before it can operate. 5(j) are the most consequential: no establishment may locate within 1,000 feet of a residential use or residential zoning district, a licensed or residential childcare facility, or any elementary, middle, high school, college or university, public or private, and no closer than 500 feet to a halfway house, correctional facility or another cannabis business; a 1,000-foot buffer also applies to any public park or house of worship.

daily, no one under 21 may be admitted, and there is no on-site sale or consumption of alcohol, tobacco or food. Cultivation, processing and manufacturing operations must install odor-absorbing ventilation so no smell is detectable on adjacent property or in shared hallways, plus noise mitigation equipment that keeps machinery within state decibel limits. Every licensed site needs security cameras covering all exterior parking, loading areas, entry points and any interior space open to the public or used to store or process product, with footage available to the Police Department on request, and at least one State-certified security guard on duty whenever the facility is open to the public.

Cultivation sites must also control lighting spillover into residential neighborhoods. Cannabis and related paraphernalia must be screened from view through exterior windows, and waste must be stored and managed under state law. 7, and refusing or hindering an inspection is itself unlawful.

Violations & Fines

Section 37-5.8 ties cannabis violations to the Township's general penalty in Chapter 1, § 1-5: a fine of up to $2,000, imprisonment up to 90 days, or up to 90 days of community service, at the Municipal Court judge's discretion. Refusing to allow the Health Department, Zoning Official, Police or Fire Department to inspect the premises under § 37-5.7 is a separate, independently punishable violation.

Frequently Asked Questions

How far must a cannabis business be from a school or park in Edison Township?
At least 1,000 feet, measured under Code § 37-5.5(j). The same 1,000-foot buffer applies to residential property and zoning districts, licensed or residential childcare facilities, and houses of worship, so most commercial corridors close to neighborhoods are off-limits.
Can a cannabis business open near a halfway house?
No. Section 37-5.5(j)(4) requires at least 500 feet of separation from a halfway house or correctional facility, and the same 500-foot buffer applies to any other licensed cannabis business, preventing dispensaries from clustering together.
What hours can a licensed cannabis establishment operate in Edison?
Public operating hours are limited to 9:00 a.m. to 7:00 p.m. daily under § 37-5.5(b), and no patron under age 21 may be admitted under § 37-5.5(c). There is no on-site consumption of cannabis, alcohol or tobacco permitted at any licensed site.
What happens if a cannabis operator violates the site standards?
Section 37-5.8 routes enforcement to the Township's general penalty ordinance, Chapter 1 § 1-5, which authorizes a fine of up to $2,000, up to 90 days in jail, or up to 90 days of community service for any violation of the site standards.
