Summary
Hayward keeps commercial cannabis retail dispensaries at least 500 feet apart to prevent overconcentration and layers in a matching 500-foot buffer from schools and other sensitive land uses. Municipal Code Section 10-1.3610(C) sets both distances and explains what happens if a school moves in near an already-permitted dispensary.
Setbacks and Buffers. In addition to the zoning requirements and development regulations contained in Chapter 10 (Zoning Ordinance), all commercial cannabis retail storefront dispensaries shall be subject to the following:1.Overconcentration. To avoid overconcentration, a commercial cannabis retail storefront dispensary shall not be located within five hundred (500) feet of any other commercial cannabis retail storefront dispensary within the City of Hayward.2.Legal Non-Conforming Use. Establishment of a school or sensitive land use, as defined in Business and Professions Code Section 26054 and Health and Safety Code Section 11362.768, within the required five hundred-foot buffer of a commercial cannabis retail storefront dispensary after such facility has obtained a conditional use permit shall render the retail storefront dispensary a legally non-conforming use, which is subject to the protections and provisions of Section 10-1.2900 (Non-Conforming Uses).

Full Breakdown
3610(C), the Setbacks and Buffers provision for Commercial Cannabis Retail Dispensaries, layers two distance rules on top of the underlying zoning and development standards in Chapter 10. First, an overconcentration rule bars a commercial cannabis retail storefront dispensary from locating within five hundred (500) feet of any other commercial cannabis retail storefront dispensary within the City of Hayward, measured citywide rather than district by district. 768. That second buffer runs the other direction as well: if a school or sensitive use is established within 500 feet of a dispensary that has already obtained its conditional use permit, the dispensary does not automatically lose its permit. 2900, so a later-arriving school cannot force an existing, lawfully permitted dispensary to close. 3604.
Violations & Fines
A dispensary sited or permitted in violation of the 500-foot overconcentration or sensitive-use buffer is subject to denial or revocation of its conditional use permit under Section 10-1.3613, Grounds for Permit Revocation or Modification, in addition to the general Municipal Code infraction and misdemeanor penalties of Section 1-3.00 that apply to Code violations citywide, including fines up to the limit set in Government Code Section 36900.
