Hayward Municipal Code allows a limited number of licensed cannabis retailers, including storefront and delivery-only operators, and cannabis manufacturing and distribution, in specified commercial and industrial zoning districts. Retail cannabis uses must maintain a 600-foot buffer from schools providing instruction in kindergarten or grades 1 through 12, day care centers, and youth centers, as required by California Business and Professions Code 26054. The City additionally establishes buffers from other sensitive uses and from other cannabis businesses, sets cap limits on the number of licenses, and requires a Cannabis Business Permit in addition to a state license from the Department of Cannabis Control. Applicants go through a competitive merit-based selection with background checks, security plans, odor control, neighborhood outreach, and a local labor peace agreement. On-site consumption may be authorized only under separate endorsement. Outdoor cultivation and outdoor signage advertising products are prohibited.
