Irvington, NJ Cannabis Regulations: Buffer Zones (2026)

Sec. 1B(6) sets a single, Township-wide buffer for every class of cannabis establishment, cultivators, manufacturers, wholesalers, retailers, and delivery services alike: there shall be a minimum setback of 200 feet from any cannabis establishment to any public or private school, child day-care center, place of worship or residential building as measured from the main entrance of each establishment. The measuring point matters. Because the 200 feet runs from the main entrance of the cannabis establishment to the protected use, rather than from the property line or lot boundary, an applicant has to plot the actual door location, not just the parcel outline, when checking whether a site clears the buffer against a nearby school, day-care center, house of worship, or residential building.

The buffer sits inside Sec. 1, which also requires the site to be in a zoning district that specifically permits the class of operation under B(5)(a) and to carry both a state conditional license and a Township permit under B(2). A site that clears the zoning-district test can still fail on the 200-foot buffer alone if a qualifying use sits within range, and the ordinance gives no variance or waiver mechanism specific to this distance requirement.
