Full Breakdown
Sec. 17-4-51(e)(24.3) sets the separation distances for a medical marijuana center measured from property line to property line: 1,000 feet from an operating school, licensed childcare center, public building, drug or alcohol rehab facility, drinking place, or another marijuana facility; 500 feet from the Interstate 25 right-of-way or a hospital; and 250 feet from the Highway 50A right-of-way (between I-25 and the ATSF railroad) and from residential zone districts. The Zoning Board of Appeals can shave the buffer by up to 10% by variance, except the school buffer can only be waived if the school's own property line is a full 1,000 feet from the facility building.
Violations & Fines
Siting a facility inside these buffers without a Zoning Board of Appeals variance blocks conditional use permit issuance and can void the state marijuana license tied to the location.
