Full Breakdown
Town Code § 213-129.3A defines 'retail dispensary' to include any location used for cannabis delivery, so delivery operations must satisfy the same industrial-district-only siting and buffer requirements in § 213-166.3 as a storefront dispensary. Separately, § 213-166.4B(3) directs the Planning Commissioner to consider requiring site plan review whenever a retail cannabis operation stores more than two delivery vehicles outdoors, alongside factors like parking variances and accessibility upgrades.
Violations & Fines
A delivery-only cannabis operation that skips the industrial-zoning and buffer rules of § 213-166.3, or stores more than two vehicles outdoors without the required site plan review, is subject to enforcement under § 213-166.5.
