Full Breakdown
Under Town of Babylon Code § 213-166.3, cannabis retail dispensaries, microbusinesses, and on-site consumption sites are permitted only in industrial zoned districts, never in residential or business zones. Buffers apply: 750 feet from any residentially zoned or used lot, 500 feet from K-12 schools and libraries, 500 feet from parks, playgrounds, child-care centers and other dispensaries, and 200 feet from churches or houses of worship. Only parcels within Suffolk County's Town of Babylon count toward these distances. Applicants need a special use permit from the Zoning Board of Appeals and must certify compliance through a licensed design professional before opening.
Violations & Fines
Operating outside these zones, or leasing space to an unlicensed seller, violates §§ 213-166.3 through 213-166.5, carrying civil penalties of $1,000 for a first offense and $2,000 for each repeat violation, plus possible special-use-permit revocation.
