Under Chapter 110's Medicinal Cannabis Businesses subchapter, the Fiscal Court permits cultivators, dispensaries, processors, producers, and safety compliance facilities (as those terms are defined in KRS Chapter 218B) to operate anywhere within Daviess County's unincorporated area, provided the business holds all required state and local licenses. ' Because Owensboro and Whitesville are separate incorporated jurisdictions, their own ordinances, not this county chapter, govern any dispensary that wants to locate inside those city limits. 46(B) layers zoning on top of the location rule, requiring every licensed cannabis business to adhere to 'all applicable zoning standards found in the Owensboro Metropolitan Zoning Ordinance, including the specific requirements of Section 8' - that zoning ordinance is administered by the Owensboro Metropolitan Planning Commission, not published in the county's general code, so it must be checked separately for district-specific siting and buffer rules.
