Eden Prairie, MN Cannabis Regulations: Dispensary Zoning (2026)

Adopted by Ordinance No. 07-2025 and amended by Ordinance No. 13-2025, Section 5.81 implements Minnesota Statutes Chapter 342's local registration authority for cannabis businesses. Subdivision 3.A bars anyone from operating a cannabis retail business in Eden Prairie without first registering with the City. Subdivision 3.B.3 makes zoning verification a condition of that registration: no application is approved until the City confirms the proposed business complies with the City's zoning regulations, and the City must certify to the Minnesota Office of Cannabis Management within thirty days of receiving a state license application whether the site meets local zoning, the State Fire Code, and the Building Code.

Subdivision 4 then caps the total number of active registrations: no more than five at any time may go to cannabis retailers, cannabis mezzobusinesses with a retail operations endorsement, or cannabis microbusinesses with a retail operations endorsement, though the cap does not apply to medical cannabis combination businesses or lower-potency hemp edible retailers. Applications are processed in the order received under Subdivision 3.B.4, and the Chief of Police approves or denies each one after confirming a valid Office of Cannabis Management license or preapproval, payment of the registration fee, current property taxes, and zoning compliance under Subdivision 3.C.

A registration is nontransferable under Subdivision 3.G and must go through a new thirty-day notice process under Subdivision 3.E if the business moves within the City. Subdivision 5.B limits retail hours to 10:00 a.m. through 9:00 p.m. Failing to register or operating outside a registration carries a civil penalty of up to $2,000 per sale under Subdivision 7.A and can also be prosecuted as a misdemeanor under Subdivision 7.B.
