Escondido, CA Cannabis Regulations: Dispensary Zoning (2026)

Section 33-1117(b)(1) of the Escondido Zoning Code prohibits all cannabis activities and uses in all zones in the city, with only the narrow exemptions listed in subsection (c). The section states that no use permit, variance, building permit, or any other entitlement, license, or permit, whether administrative or discretionary, shall be approved or issued for the establishment or operation of cannabis related activities or uses in the City of Escondido, and that no person or entity shall otherwise establish or conduct such activities in the city.

That means there is no zoning district, from downtown commercial to industrial parks, where a storefront dispensary, delivery hub, cultivation site or manufacturing operation can be legally sited or licensed. Subsection (a) borrows its cannabis definitions from the Medicinal and Adult Use Cannabis Regulation and Safety Act at California Business and Professions Code Section 26000 et seq. 1 at a private residence, provided the activity stays wholly inside the home and out of public view, and pass-through transportation, letting a licensed cannabis business move product on public roads through Escondido to a destination outside city limits without stopping to deliver.

The section explicitly forbids delivery of any cannabis product to a residence, office, commercial site or other place within the city limits, closing the delivery loophole some neighboring cities allow. The current ban was adopted by Ordinance No. 2018-03R on March 21, 2018; its editor's note records that Escondido had earlier repealed a 2016 medical marijuana ordinance (Ord. No. 2016-01) before settling on this blanket citywide prohibition.
