Gardena, CA Cannabis Regulations: Dispensary Zoning (2026)

Section 18.66.030(A) of the Gardena Municipal Code prohibits commercial cannabis activities, for profit or not, in all zones in the city, including every specific plan area and overlay zone, and bars any business enterprise that complimentarily provides cannabis alongside a non-cannabis activity. Subsection B extends the ban to property owners: a landlord may not rent, lease or otherwise permit any tenant to occupy real property in Gardena for commercial cannabis activity. Subsection C separately prohibits all deliveries of nonmedicinal cannabis that either originate or terminate within the city, though the city cannot block deliveries merely passing through on city streets.

Subsection D confirms the city will not issue any permit, license or entitlement for an activity requiring a state cannabis license, including a local nonprofit license under Business and Professions Code Section 26070.5, with one exception: a permit for a medicinal cannabis delivery service under Chapter 5.80. Subsection E bans all cannabis cultivation in every zone in the city except as allowed by Section 18.66.040, which lets an adult twenty-one or older grow up to six marijuana plants for personal use inside a private residence or a fully enclosed, locked accessory structure, capped at 150 square feet, with no outdoor cultivation permitted under any circumstance.

Subsection F clarifies the citywide prohibition does not reach delivery by a state-licensed nonstorefront retailer of medicinal cannabis to a qualified medicinal patient. Violating Chapter 18.66 is declared a public nuisance under Section 18.66.050 and a misdemeanor under Section 18.66.060, and the city may summarily abate any violating use or condition under Section 18.66.070, citing Code of Civil Procedure Section 731, independent of any criminal prosecution.
