Full Breakdown

Cannabis storefront and non-storefront retailers are excluded from every residential zone in Indio (Table 2.02.02-1 marks the use "X" in DE-1, DET-3, SN-4, SN-8, and MH). Under UDC Chapter 4.07, retailers are permitted only in all Mixed-Use zones, the Regional Commercial zone, or on Specific Plan/Project Master Plan properties allowing commercial uses (excluding any zoned Neighborhood Commercial). Even in those zones, a retailer must sit at least 600 feet from any parcel designated a sensitive use under Municipal Code § 123.32(B)(2), and at least 250 feet from any church in a residential zone existing when the Cannabis Business Permit issues. Operators must also hold a Cannabis Business Permit under Chapter 123, a City business license, and a state seller's permit.

Violations & Fines

Operating a dispensary in a residential, non-qualifying, or Neighborhood Commercial zone, inside the 600-foot sensitive-use buffer or 250-foot church buffer, or without a valid Cannabis Business Permit voids City approval and can trigger permit denial or revocation.
