Novi, MI Cannabis Regulations: Dispensary Zoning (2026)

Section 22-9, adopted by Ordinance No. 19-193 on February 11, 2019, invokes Section 6(1) of the Michigan Regulation and Taxation of Marihuana Act, Initiated Law 1 of 2018, MCL 333.27956(1), which lets a municipality prohibit marijuana establishments by its own ordinance. Subsection (a) states the city's intent, noting that adopting the ban does not stop Novi from studying or revisiting the issue later. Subsection (b) carries out the prohibition itself: it adopts the definitions used in the state act, then declares that all marijuana establishments are prohibited within the boundaries of the city.

That single sentence functions as a citywide opt-out, meaning no parcel or zoning district in Novi, including its commercial corridors, may host a state-licensed grower, processor, retailer, secure transporter, safety compliance facility or microbusiness under the act. The section sets its own penalty rather than relying on the Code's general misdemeanor default: a violation is a municipal civil infraction under Chapter 1, Section 1-11, and the violator must also pay all direct and indirect costs the city incurs enforcing the ban, on top of any injunctive relief the city seeks in court.

Each day a prohibited establishment continues operating is treated as a separate offense, so the exposure compounds daily until the business closes or the city obtains an injunction.
