Parsippany-Troy Hills, NJ Cannabis Regulations: Dispensary Zoning (2026)

Dispensary zoning in Parsippany-Troy Hills has two layers: a conditional use in the zoning chapter and a license cap in Chapter 119.

Under § 430-88G, in the B-1 Highway Commercial District, a cannabis establishment associated with a Class 5 cannabis retailer is a conditional use. The licensee must be located on a lot with frontage on the arterial roadways of New Jersey State Highway Route 10 and 46 as designated by the 2010 Functional Classification Map for Morris County. The conditional use sections for the B-2 Highway Development District (§ 430-96), the B-2A Limited Highway Development District (§ 430-104) and the O-T Office Transitional District (§ 430-213.1) each make a dispensary conditional subject to § 430-88G in its entirety. Other conditions: drive-through services are prohibited, the store cannot sell groceries or engage in licensed retail sales of alcoholic beverages, signs cannot display a cannabis leaf, and no cannabis-related products can be visible from the exterior of the building. Section 430-88G(11) also sets a 100-foot distance from residential lot lines.

Chapter 119 sits on top. Section 119-3 says any cannabis license can be used only in strict accordance with the Township's land use and location requirements. The § 119-4D table lists a maximum of 3 licenses for the Class 5 retailer class, with a $10,000 nonrefundable application fee, a $25,000 initial license fee and a $25,000 annual renewal fee, and the Township Council can change those figures by resolution. The Business Administrator is the local licensing authority, no local license takes effect until the state issues its license, and cannabis microbusinesses are not permitted in the Township (§ 119-2). Dispensary hours are 8:00 a.m. to 10:00 p.m., Monday through Saturday (§ 119-4F(1)). Every applicant needs site plan approval from the Planning Board or Board of Adjustment and a host community agreement, plus a zoning official's letter, for a $100 fee, confirming the location complies (§ 119-6E(4)). A Township Council resolution of support expires within 12 months unless the business secures a state license, with a six-month extension for a $2,500 fee (§ 119-4E).
