Where the use fits depends on the zone. Section 430-85 lists personal services as a permitted use in the B-1 Highway Commercial District, and the same permitted-use item appears in the B-2 (§ 430-93), B-2A (§ 430-101), B-3 (§ 430-109), B-4 (§ 430-118) and B-5 (§ 430-126) districts, the O-S Office-Service District (§ 430-134) and the O-T Office Transitional District (§ 430-212). The OVL-3 and OVL-5 overlay districts (§§ 430-394 and 430-405) list pet retail stores including grooming and exclude animal kennels and animal day or night boarding facilities. A pet shop in the B-1 District must sit in a freestanding structure and not share common walls with other uses (§ 430-85N).

Residential land is different. In the R-R Residential District, § 430-39 prohibits kennels as defined in Chapter 91 and prohibits any use not specifically authorized as a permitted, accessory or conditional use.

Before a groomer starts operating, the Administrative Officer must issue a zoning permit under § 430-295A. The fee for a new tenant, with or without renovations, is $75 (§ 430-295E). Under § 430-22, a building permit for a building or use, or an enlargement, needs an approved site plan under Chapter 225 unless the project is a single-family dwelling or a permitted accessory use incidental to one.

Violations & Fines

Running a grooming business in a district that does not list the use, or opening without a zoning permit, violates Chapter 430. Under § 430-299 a conviction carries one or more of a fine of not less than $100 and not more than $2,000 for each violation and each day it persists, up to 90 days in the county jail, or up to 90 days of community service. Can I run a dog grooming business from my home in Parsippany-Troy Hills?
