Syracuse, NY Cannabis Regulations: Dispensary Zoning (2026)

Chapter 27's Article 12, added by Gen. Ord. No. 13-2014 and amended by Gen. Ord. No. 2-2023, folds "adult-use cannabis retail dispensary" and "adult-use on-site cannabis consumption establishment" into the citywide business certificate of use scheme. Section 27-163 defines both as premises licensed under the New York State Cannabis Law, for retail sale and on-site consumption respectively, and groups them with bars, drugstores, restaurants, cannabinoid hemp retailers and smoking establishments as regulated "businesses." Under § 27-164(a)-(b), no proprietor may operate and no owner may allow one to operate without first obtaining a certificate of use, or a conditional certificate while requirements are still being met, for that specific location.

Applications go to the division of code enforcement under § 27-165, and § 27-166 requires the director of code enforcement, the fire chief and the zoning administrator to inspect the premises, with the zoning administrator separately confirming the location complies with the zoning ordinance; the police chief runs a criminal background check evaluated under Article 23-A of the state Correction Law. Section 27-167 conditions issuance on paying the § 27-169 fee of $500 every two years, holding all other required licenses, owing the city no delinquent taxes, water charges or fines, and clearing the background screen, which flags felony convictions for theft, fraud or drug sales within five years and matching misdemeanors within two years. A certificate runs two years from issuance under § 27-170, and § 27-171 requires renewal at least 60 days before expiration. Section 27-176's point system assigns four points to violations of the Cannabis Law (Consolidated Laws Ch. 7-A) or Penal Law Article 222; accumulating 12 points in 12 months, or 18 in 24 months, is deemed a failure to maintain good order that can trigger suspension or revocation of the certificate.
