" There is no zoning district in Westminster where any of these uses are allowed; the ban applies citywide rather than steering the businesses to an industrial or commercial zone. The City Council grounded this in its home rule authority under Article XX, Section 6 of the Colorado Constitution, combined with the express authorization in Article XVIII, Section 16 of the Colorado Constitution allowing municipalities to prohibit marijuana establishments by ordinance, finding that the secondary impacts of retail marijuana sale, cultivation, and manufacturing have an unacceptable adverse effect on health, safety, and welfare.

C. Personal use is untouched: Section 5-10-6 states the chapter does not prohibit or regulate personal recreational use of marijuana by adults 21 or older under Article XVIII, Section 16, as long as that personal use does not involve selling marijuana or operating a marijuana establishment in the City. In short, an adult may possess and consume marijuana personally in Westminster, but no storefront dispensary, grow operation, or infused-products manufacturer can legally locate anywhere within city limits.
