Home cultivation of cannabis is illegal in Florida. Florida law does not permit patients or caregivers to grow marijuana at home, even with a valid medical marijuana card. Florida law prohibits the home cultivation of cannabis for any purpose, whether recreational or medical. Patients with a valid medical marijuana card must purchase all cannabis products from a licensed MMTC. There is no home-grow provision in Florida's medical marijuana statute, unlike some other states. Growing even a single cannabis plant at home is a criminal offense under Florida Statute 893.13, regardless of the grower's medical marijuana patient status. Possession of more than 25 cannabis plants is a second-degree felony. Coral Gables enforces state law and the city's Code Enforcement Division may investigate reports of cannabis cultivation as a nuisance or zoning violation in addition to criminal penalties. The city's strict property maintenance standards and Board of Architects oversight of exterior appearance further restrict any visible cultivation activities.
