Florida does not permit home cultivation of cannabis for any purpose β medical or recreational. The state's medical marijuana program under FL Statute Section 381.986 (Amendment 2, approved 2016) allows qualifying patients to purchase cannabis products from licensed Medical Marijuana Treatment Centers (MMTCs), but growing plants at home is expressly prohibited. Recreational marijuana remains illegal in Florida; possession of 20 grams or less is a first-degree misdemeanor, and possession over 20 grams is a third-degree felony. Growing even a single cannabis plant constitutes manufacturing under Florida law, which is a felony carrying up to 5 years in prison and a $5,000 fine for fewer than 25 plants. Medical marijuana patients in Homestead can obtain products from licensed dispensaries with a valid Medical Marijuana Use Registry ID card. Miami-Dade County does not have any local ordinances decriminalizing cannabis possession.
Growing cannabis is a felony (manufacturing). Fewer than 25 plants: up to 5 years prison and $5,000 fine. 25+ plants: up to 15 years and $10,000. Contact is not applicable as this is a criminal matter.
