CBD hemp products derived from industrial hemp with less than 0.3% THC are legal under the 2018 Farm Bill and Florida's hemp program but growing hemp also requires a state license.

Cultivation of 25 or fewer plants is a third-degree felony punishable by up to 5 years in prison and a $5,000 fine.
