Livermore, CA Cannabis Regulations: Home Cultivation (2026)

2 sits in Article 2 (Cannabis) of the Uniform Controlled Substances Act, Chapter 6, and was added to the Health and Safety Code on November 8, 2016 by initiative Proposition 64, then amended by Stats. 2017, Ch. 27, Sec. 130 (SB 94), effective June 27, 2017. 5 grams must stay inside the private residence or on its grounds, in a locked space that is not visible to normal unaided vision from a public place; and no more than six living plants may be cultivated, harvested, dried, or processed at a single private residence at one time, whether the plants are indoors or outdoors.

Subdivision (b) then sets the limits on what Livermore itself may do: the city may enact reasonable regulations governing that cultivation, but it cannot completely prohibit growing indoors, or inside a fully enclosed and secure accessory structure on the property. The city may, however, completely prohibit outdoor cultivation on the grounds of a private residence, and that outdoor-ban authority stays available unless the California Attorney General finds federal law now treats adult cannabis use as legal. 030; it does not regulate noncommercial personal cultivation at a private residence, so nothing in the general code reviewed here narrows the state allowance further.

Private residence for purposes of this protection means a house, an apartment unit, a mobile home, or a similar dwelling, so renters growing inside a rented apartment carry the same six-plant right as homeowners.
