Proposition 64 (Health and Safety Code 11362.1 and 11362.2) allows adults 21 and older to possess up to 28.5 grams of cannabis and cultivate up to 6 living plants per private residence for personal use. Cities may regulate but not prohibit personal cultivation. Rancho Cordova requires personal cultivation to occur indoors within a fully enclosed, locked, secure area of the residence or within a fully enclosed and secure accessory structure. Outdoor cultivation visible from any public place or private property is prohibited. Cultivation areas must be ventilated and use safe electrical installations to prevent fire risk. Rental property owners may still prohibit cultivation in leases. Smoke and odor from cultivation cannot constitute a nuisance affecting neighbors. Cultivation for sale or gifting outside personal use is commercial activity requiring state licensing.
Exceeding the 6-plant limit or cultivating visibly outdoors is an infraction or misdemeanor with fines up to 500 dollars. Unlicensed commercial cultivation triggers state and local enforcement.
