Under California Health & Safety Code Β§11362.2 (Prop 64, 2016), adults 21 and older may possess, plant, cultivate, harvest, and process up to 6 living cannabis plants per private residence for personal use. Cities cannot ban indoor personal cultivation but may impose reasonable regulations. Elk Grove Municipal Code Chapter 9.42 (adopted 2017 following Prop 64) permits personal cultivation only indoors in a residence or within a fully enclosed, locked, opaque secure structure on the same parcel. Outdoor cultivation visible from any public place or adjoining property is prohibited. Cultivation area must not be accessible to minors. Commercial cultivation is banned citywide. Cannabis odor must not create a nuisance to neighboring properties.
