Kyle, TX Code Violation Reporting: Common Violations (2026)

Under Kyle City Code Section 23-284, whenever a nuisance on any lot inside the city limits comes to the city's attention, a code enforcement officer, animal control officer, building inspector, or Kyle police officer prepares a written notice identifying the property and orders the owner, or whoever has possession or control, to abate it within ten days. The ordinance defines abatable nuisances broadly: debris, weeds, brush, rubbish, decaying vegetation, a junked vehicle, a nonconforming building or structure, unsightly or unsanitary matter of any kind, or a lot that needs filling, draining, or leveling to stop standing water.

Section 23-285 sets service rules: the officer delivers the notice to the owner personally, leaves it at the owner's home or business inside Kyle, or, for a firm or corporation, serves any authorized officer or agent; if the owner lives outside the city, mailing a letter to their known address is enough. If the owner fails, neglects, or refuses to abate within the deadline, Section 23-286 lets the enforcing officer file a complaint in the Municipal Court of the City of Kyle. For nuisances that are not zoning violations, the city manager can instead report the failure to the city council, which can authorize the city manager to abate the nuisance directly, without any further notice to the owner.

Section 23-287 requires that work be done by the lowest qualified bidder or by city labor under the building official's or city manager's supervision. Once complete, Section 23-288 bills the owner within ten days; unpaid bills convert into a filed statement with the Hays County Clerk that adds a $150.00 administrative fee and accrues 10 percent annual interest as a privileged lien, ranking behind only tax and street-improvement liens. Section 23-289 lets the city sue to foreclose that lien in any court with jurisdiction, with the city's cost statement standing as prima facie proof of the amount owed.
