Dispensary Zoning

Cass County Code § 400.261 controls where marijuana businesses, including dispensaries, cultivation and processing facilities, may operate in the unincorporated area. Facilities cannot occupy a building that also contains a residence, must keep all operations and storage fully enclosed indoors, and must close to the public overnight. Planning and Zoning enforces these siting rules countywide.

Cass County Code § 400.261(B)(1) keeps new medical and marijuana facilities at least 1,000 feet from any then-existing elementary or secondary school, child day care center or church in the unincorporated county. The distance is measured along the shortest legally walkable path between the closest building walls or property lines, not a straight line.
