Dispensary Zoning

Unincorporated Josephine County allows marijuana producers, processors, wholesalers, retailers and labs to operate, but only with an annual compliance certificate from the Community Development Department, a valid OLCC or OHA license, and a Land Use Compatibility Statement confirming the zone allows the use. The county caps how many of each business type it will license under Josephine County Code § 19.99B.020.

A. No marijuana business may lawfully operate in the County without: 1. A marijuana compliance certificate issued by the Josephine County Community Development Department; 2. Proof of a valid license from the OLCC, OHA or other appropriate state regulatory agency; and 3. A Land Use Compatibility Statement (LUCS) stating the use is not prohibited.

Buffer Zones

Unincorporated Josephine County keeps new or relocated marijuana retail and dispensary sites 1,000 feet from any school, daycare or church, and 1,000 feet from any other marijuana retailer, under Josephine County Code § 19.99B.040(B). Nonconforming marijuana production sites must also keep their plants at least 150 feet from dwellings on neighboring lots under § 19.99B.050(E).
