(1) Children Under Sixteen: It is unlawful for any juvenile who is under sixteen (16) years of age to remain upon any street, highway, road, alley, park, playground or other public places, or buildings or places of amusement, eating establishments, vacant lots and/or any other place, without being accompanied by an adult having custodial rights or an adult person designated by the adult having custodial rights of said child between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M. of the following day ... (2) Weekday Curfew: It is unlawful for any juvenile, being an individual who is between sixteen (16) and eighteen (18) years of age, to remain upon any street, highway, road, alley, park, playground or other public places, or buildings or places of amusement, eating establishments, vacant lots and/or any other place ... during the weekdays, specifically Sunday through Thursday, between the hours of eleven o'clock (11:00) P.M. and six o'clock (6:00) A.M. of the following day ... (3) Weekend Curfew: ... during the weekends, specifically Friday and Saturday, between the hours of twelve o'clock (12:00) midnight and six o'clock (6:00) A.M. of the following day

The ordinance is enacted under article 12, section 2 of the Idaho Constitution and Idaho Code sections 31-714, 31-801 and 31-828, and it applies only in unincorporated Canyon County; Caldwell, Nampa and the county's other incorporated cities set their own curfew rules, if any.
Violations & Fines
Section 03-11-09 separately makes it unlawful for a parent, guardian or other legal custodian to knowingly permit a child under 18 to violate the curfew without arranging supervision. Under section 03-11-11, a curfew violation is a misdemeanor under Idaho Code section 18-113, but a second conviction of a parent or guardian under section 03-11-09 draws a fine of at least $100, a third conviction at least $200, and every conviction after that at least $250 plus a minimum of one day in the Canyon County jail, on top of any probation or other court-ordered sanction. Juveniles themselves are handled under Idaho's Juvenile Corrections Act, Idaho Code title 20, chapter 5.
