Chesapeake City Code establishes a juvenile curfew under authority of VA Code Section 15.2-926. The ordinance applies to persons under 18 in any public place, street, park, or business open to the public. Curfew hours are 11 PM to 6 AM Sunday through Thursday and 12 AM to 6 AM Friday and Saturday. Standard exceptions include: accompanied by parent, legal guardian, or adult 21 or older with parental permission; traveling directly to or from lawful employment; attending an official school, religious, or recreational activity sponsored by Chesapeake or a recognized civic organization; responding to an emergency; and exercising First Amendment rights (protected speech, assembly, or free exercise of religion). Violations are a Class 4 misdemeanor or civil penalty depending on enforcement choice; parents or guardians who knowingly permit violations can also be penalized.
